تصعيد تاريخي للمحامين المغاربة: إضراب شامل رفضاً لمشروع قانون “مقلق”

أعلنت جمعية هيئات المحامين بالمغرب، في خطوة تصعيدية حاسمة، استمرار التوقف الشامل عن العمل إلى أجل غير مسمى، ومقاطعة المنصات الرقمية للقضاء. يأتي هذا القرار بعد انسداد أفق الحوار مع الحكومة بشأن مشروع القانون رقم 66.23، الذي ترى فيه الهيئات المهنية تهديداً خطيراً لاستقلاليتها وحق الدفاع.
وتركز معارضة المحامين على نقاط جوهرية في المشروع، أهمها نقل صلاحية الإذن النهائي بتسجيل المحامين الجدد من الهيئات المهنية إلى السلطة الحكومية، مما يقوض مبدأ التنظيم الذاتي. كما يرفضون شروطاً مقيدة جديدة للالتحاق بالمهنة وقيادتها، وبنوداً تنظيمية للعلاقة المالية مع الموكلين يرون فيها تدخلاً غير مسبوق.
يتسبب هذا الإضراب غير المحدد في شلل جزئي في سير العدالة، مع تعطيل الجلسات وتأجيل القضايا، مما يمس حقوق الآلاف من المتقاضين. وقد وجهت الجمعية الدعوة إلى المجلس الأعلى للسلطة القضائية لاتخاذ التدابير اللازمة لحماية هذه الحقوق، في إطار تصعيد مؤسسي أوسع.
تمثل هذه المواجهة منعطفاً مصيرياً في العلاقة بين السلطة والمهنة الحارسة لحقوق الدفاع. تحول النقاش من إطار قانوني تقني إلى معركة مبادئ حول استقلال القضاء. مستقبل الأزمة مرهون بفتح قنوات حوار حقيقية أو الاستعداد لتحول النضال المهني إلى أزمة مؤسسية طويلة الأمد.
