العدالة الجنائية في ضوء التشريعات الإسلامية الحديثة: قراءة تحليلية لكتاب الدكتور سعيد بوتشكوشت

(في هذا العمل الجريء، يقدّم الدكتور سعيد بوتشكوشت قراءة فكرية متجددة للعدالة الجنائية في ضوء التشريعات الإسلامية الحديثة. بين النص والمقصد، وبين الشريعة والحداثة، يطرح المؤلف سؤالًا عميقًا: كيف يمكن بناء عدالة تصون كرامة الإنسان وتبقى وفية لروح الإسلام؟ دراسة تفتح أفقًا جديدًا للفكر القانوني الإسلامي وتعيد للعدالة معناها الإنساني الأصيل.)
بين المقاصد والحداثة
في زمنٍ تتنازع فيه المرجعيات القانونية بين النصوص الوضعية الصارمة والمبادئ الأخلاقية المتعالية، يأتي كتاب الدكتور سعيد بوتشكوشت «العدالة الجنائية على ضوء التشريعات الإسلامية الحديثة» ليعيد صياغة السؤال المؤسس:
هل يمكن للعقل الإسلامي أن يؤسس عدالة جنائية معاصرة تحفظ للإنسان كرامته، وتبقى في الوقت نفسه وفية لروح الشريعة ومقاصدها العليا؟
يجيب المؤلف، بجرأة أكاديمية ورؤية نقدية عميقة، أن العدالة في الإسلام ليست نظامًا عقابيًا جامدًا، بل منظومة قيمية حضارية متجددة قادرة على التفاعل مع التحولات العالمية من موقع الفاعل لا المفعول به.
وهنا يكمن سرّ فرادة الكتاب: فهو لا يعيد إنتاج الموروث، بل يبعث فيه الحياة من جديد عبر منظور قانوني حديث.
1. العدالة كقيمة كونية لا كآلية عقابية
يبدأ المؤلف بتفكيك مفهوم العدالة من منبعه القرآني والإنساني معًا، مبينًا أن العدالة في أصلها ليست مجرد ردع للجريمة، بل فعل إنقاذ للإنسان من ذاته ومن المجتمع على السواء.
فالعقوبة في الإسلام — كما يؤكد المؤلف — ليست انتقامًا، بل تطهيرٌ وإصلاحٌ (1).
وهذا التوجه يجد صداه في الفكر الفلسفي الغربي الحديث، خصوصًا عند جون رولز في كتابه A Theory of Justice (1971) حين اعتبر العدالة “الفضيلة الأولى للمؤسسات الاجتماعية” (2)، غير أن الفرق الجوهري هو أن العدالة في التصور الإسلامي ترتكز على مبدأ التوحيد والمقصد الأخلاقي، بينما تنطلق عند رولز من العقد الاجتماعي والعقل الإجرائي.
هذا التباين الفلسفي العميق هو ما يجعل عمل المؤلف فريدًا؛ إذ يثبت أن المنظومة الإسلامية قادرة على إنتاج نظرية عدالة ذات بعد أخلاقي وروحي دون الحاجة إلى المرجعية الوضعية الغربية.
2. المنهج المقارن كأداة لبناء رؤية تجديدية
اعتمد الدكتور سعيد بوتشكوشت منهجًا مقارنًا ثلاثي الأبعاد:
▪︎ المقارنة بين الفقه الإسلامي والمدونات الجنائية الحديثة في العالم العربي (المغرب، مصر، الإمارات…)؛
▪︎ المقارنة بين هذه التشريعات والنظم الغربية الحديثة؛
▪︎ المقارنة بين النصوص القانونية والمقاصد الشرعية.
بهذا المنهج، استطاع المؤلف أن يبرهن أن التشريع الجنائي الإسلامي — حين يُقرأ في ضوء المقاصد الكبرى — يملك قدرة مذهلة على التكيّف الحضاري دون التفريط بالثوابت (3).
ولعل هذا ما يجعله قريبًا من المدرسة الفكرية التي يمثلها أمارتيا سن في كتابه The Idea of Justice (2009)، حين دعا إلى تجاوز العدالة الشكلية نحو عدالة واقعية تراعي كرامة الإنسان وسياقه الاجتماعي (4).
غير أن المؤلف يضيف بعدًا آخر مفقودًا في الفكر الغربي: البعد الإيماني الذي يجعل العدالة مسؤولية أخلاقية أمام الله لا أمام الدولة فحسب.
3. فلسفة العقوبة بين الردع والإصلاح
يقدم الكتاب معالجة دقيقة لمفهوم العقوبة في التشريعات الإسلامية الحديثة، معتبرًا أن المقاصد الكبرى للشريعة — حفظ النفس والكرامة والعدل — تقتضي تجاوز العقوبة الانتقامية نحو العقوبة الإصلاحية.
ويُبرز المؤلف كيف أن الحدود والقصاص ليست الغاية النهائية، بل وسيلة لضمان العدالة الاجتماعية وتحقيق الردع المتوازن (5).
وفي هذا الصدد، يلتقي فكر بوتشكوشت مع نظرية ميشيل فوكو في Surveiller et punir (1975)، حين انتقد الأخير التحول التاريخي للعقوبة من جسدية إلى رمزية، مشيرًا إلى أن جوهرها يجب أن يظل إنسانيًا ومصلحيًا (6).
غير أن الفارق أن فكر المؤلف يرى العدالة نابعة من سلطة القيم والمقاصد الإلهية — أي من ضمير العدل لا من جهاز العقاب.
4. العدالة الجنائية بين النص والمقصد
من أعمق محاور الكتاب تلك التي تتناول علاقة النص بالمقصد.
يرى المؤلف أن الخطأ التاريخي الذي وقع فيه كثير من المشرعين المعاصرين هو فصل النصوص الجنائية عن سياقها المقاصدي. فالآية التي تشرع القصاص مثلًا لا تُفهم بمعزل عن مقصدها الأخلاقي: “ولكم في القصاص حياة يا أولي الألباب” (7).
هذه القراءة المقاصدية تمثل في جوهرها ثورة فكرية داخل الفقه الجنائي الإسلامي، لأنها تعيد بناء التشريع على أساس الغاية لا الوسيلة.
وهنا يتقاطع المؤلف مع مفكرين معاصرين مثل طارق رمضان في كتابه Radical Reform (2008)، الذي دعا إلى تجديد الفقه من الداخل عبر “إعادة الوصل بين النص والواقع” (8).
5. البعد الإنساني في العدالة الإسلامية
من أجمل ما في هذا الكتاب هو إصرار المؤلف على أن العدالة في الإسلام ليست ضد الإنسان، بل هي في خدمته.
فالحدود والقصاص والعقوبات — رغم قسوتها الظاهرية — تستند إلى فلسفة تحترم الإنسان باعتباره خليفة الله في الأرض.
يقول بوتشكوشت بوضوح:
“العدالة في الإسلام لا تبحث عن إدانة الجاني، بل عن إنقاذ المجتمع من الظلم والاضطراب.”
وهذه الفكرة ترتقي بالفقه الإسلامي من كونه نصوصًا جامدة إلى كونه مشروعًا حضاريًا متجددًا.
إنه ذات الأفق الذي تحدث عنه جوزيف راز في The Morality of Freedom (1986) حين اعتبر الحرية قيمة لا يمكن فصلها عن المسؤولية الأخلاقية (9).
لكن بينما يربط راز الأخلاق بالحرية الفردية، يربط المؤلف الأخلاق بالعدالة الجماعية في إطار الأمة.
6. رؤية نقدية وموقع الكتاب في الفكر العالمي
من الناحية الأكاديمية، يمكن القول إن كتاب الدكتور سعيد بوتشكوشت ينتمي إلى تيار “الفقه المقارن المتنور”، الذي يسعى إلى تأسيس نموذج ثالث بين الفقه التقليدي والحداثة الغربية.
ولذلك يختلف عن الاتجاهات السائدة في الأدبيات العالمية التي غالبًا ما تنظر إلى الشريعة كمنظومة جامدة، في حين يثبت المؤلف أنها منظومة دينامية متحركة قادرة على التجديد الذاتي (10).
الكتاب إذًا لا يكرر خطاب الدفاع، بل يقدم خطابًا معرفيًا جديدًا:
▪︎ إسلام العدالة، لا إسلام العقوبة؛
▪︎ إسلام الإنسان، لا إسلام الردع؛
▪︎ إسلام المقصد، لا إسلام النص المجرد.
7. انعكاسات فكر بوتشكوشت على الواقع التشريعي المغربي والعربي
من الزاوية التطبيقية، لا يمكن تجاهل أن فكر المؤلف بدأ يجد صداه في التحولات التشريعية بالمغرب، لاسيما في النقاش الدائر حول مراجعة المنظومة الجنائية ومبدأ العدالة التصالحية.
إن دعوته إلى قراءة مقاصدية حديثة للنصوص القانونية تنسجم مع توجهات الدولة نحو مواءمة القوانين الوطنية مع المرجعية الحقوقية والهوية الإسلامية، وهو ما برز في مشاريع إصلاح قانون المسطرة الجنائية وقانون العقوبات (11).
كما أن أطروحته تشكل أرضية فكرية يمكن البناء عليها عربيًا لإرساء نموذج عدالة يقوم على الكرامة والفعالية بدل الزجر والانتقام، في انسجام مع تطور الفكر القانوني الإنساني العالمي.
إن فكر بوتشكوشت، بهذا المعنى، لا يظل حبيس الورق، بل يمتد أثره إلى الممارسة التشريعية، ليجعل من العدالة مشروعًا مجتمعيًا حيًّا لا نظرية مثالية مجردة.
نحو عدالة إنسانية عالمية
في ختام هذا العمل، لا يمكن للباحث إلا أن يعترف بأن الدكتور سعيد بوتشكوشت قد أطلق مشروعًا فكريًا يستحق أن يُدرّس في كليات الحقوق والفكر الإسلامي على السواء.
لقد وضع المؤلف لبنة أولى نحو عدالة إنسانية شمولية، تتجاوز حدود الجغرافيا والدين، لتخاطب ضمير الإنسان في كل زمان ومكان.
هذا الكتاب لا ينتمي فقط إلى الفكر الإسلامي، بل إلى الفكر الإنساني العالمي.
ولعل ما يميزه حقًا هو أنه يستعيد روح الإسلام بوصفه مشروعًا للعدالة، لا منظومة للعقوبة.
وفي عالمٍ يعاني من طغيان المصلحة على القيم، يأتي صوت المؤلف تذكيرًا بأن:
“العدالة ليست قانونًا يُطبَّق، بل ضميرًا يُحيا.”
