صدور مرسوم بتعديلات قانون الجنسية الكويتي .. إليك وضع الزوجة الأجنبية والأبناء
كشفت وسائل إعلام كويتية عن أبرز تعديلات قانون الجنسية الكويتية بعد صدور المرسوم اليوم الاثنين رسمياً.
ووفقا للقبس الكويتية ، فقد صدر مرسوم بقانون رقم 116 لسنة 2024، بتعديل بعض أحكام المرسوم الأميري رقم 15 لسنة 1959 بقانون الجنسية الكويتية.
وجاء ذلك، بعد الاطلاع على المرسوم الأميري رقم 15 لسنة 1959 بقانون الجنسية الكويتية، والقوانين المعدلة له، وعلى المرسوم رقم 84 لسنة 2024 في شأن الحلول والإنابات الوزارية، والمراسيم المعدلة له، وبناء على عرض النائب الأول لرئيس مجلس الوزراء ووزير الداخلية وبعد موافقة مجلس الوزراء، وفيما يلي نص المرسوم الجديد:
مادة أولى
يستبدل بنص الفقرتين الأولى والثانية من المادة (7)، وبنصوص المواد (8) و(13) من المرسوم الأميري رقم (15) لسنة 1959 المشار إليه، النصوص الآتية:
مادة (7) فقرة أولى وثانية:
لا يترتب على كسب الأجنبي الجنسية الكويتية أن تصبح زوجته كويتية، ويعتبر أولاده القصر كويتيين ولهم أن يقرروا اختيار جنسيتهم الأصلية خلال السنة التالية لبلوغهم سن الرشد.
وتسري علي الأولاد في حالة بقائهم على الجنسية الكويتية، أحكام المادة السابقة.
مادة 8
لا يترتب على زواج المرأة الأجنبية من الكويتي أن تصبح كويتية.
يجوز بمرسوم بناء على عرض وزير الداخلية، سحب الجنسية الكويتية من الكويتي الذي كسب الجنسية الكويتية، وذلك في الحالات الآتية:
1- إذا كان قد منح الجنسية الكويتية بطريق الغش أو التزوير أو بناء على أقوال كاذبة، وتسحب الجنسية الكويتية ممن يكون قد كسبها معه بطريق التبعية.
2- إذا حكم عليه بحكم بات بعد منحه الجنسية الكويتية في جريمة مخلة بالشرف أو الأمانة أو بجريمة من جرائم أمن الدولة الداخلي أو الخارجي أو في جريمة المساس بالذات الإلهية أو الأنبياء أو الذات الأميرية.
3- إذا فصل تأديبيا من وظيفته الحكومية، لأسباب تتصل بالشرف أو الأمانة خلال عشر سنوات من منحه الجنسية الكويتية.
4- إذا استدعت مصلحة الدولة العليا أو أمنها الخارجي ذلك، ويجوز في هذه الحالة سحب الجنسية الكويتية ممن يكون قد كسبها معه بطريق التبعية.
5- إذا توافرت الدلائل لدى الجهات المختصة على قيامه بالترويج لمبادئ من شأنها تقويض النظام الاقتصادي أو الاجتماعي في البلاد أو على انتمائه إلى هيئة سياسية اجنبية، ويجوز في هذه الحالة سحب الجنسية الكويتية ممن يكون كسبها معه بطريق التبعية.
