نظرة عامة على الفصل 507
يعد الفصل 507 من القانون الجنائي المغربي أحد النصوص التشريعية المشددة التي تتعامل مع جريمة السرقة عندما ترتكب باستعمال السلاح، حتى لو لم يتم استخدامه فعليًا. فهو يركز على الردع بسبب الخطورة الكامنة في تواجد السلاح أثناء ارتكاب الجريمة.

“يعاقب بالسجن المؤبد كل سارق كان، أو أحد الشركاء في الجريمة، حاملاً لسلاح ظاهر أو مخفي، حتى لو كان السارق شخصاً واحداً ولم تتوفر ظروف مشددة أخرى.
كما تطبق نفس العقوبة إذا احتفظ السارقون أو أحدهم بالسلاح في الناقلة ذات المحرك التي استعملت في نقلهم إلى مكان الجريمة أو لهروبهم.”
الشرح التفصيلي لعناصر الجريمة والعقوبة
1. العقوبة المقررة
· العقوبة: السجن المؤبد.
· هذه أقصى عقوبة في القانون المغربي بعد إلغاء عقوبة الإعدام، مما يعكس جسافة هذه الجريمة في نظر المشرع.
2. الظرف المشدد الأساسي: حيازة السلاح
الظرف المشدد هنا هو مجرد حمل السلاح أو وجوده في مكان قريب، دون اشتراط استعماله. وينقسم هذا إلى حالتين:
أ. الحمل المباشر للسلاح:
· الفاعل: كل سارق أو أي شريك في الجريمة.
· الشرط: أن يكون حاملاً لسلاح (سواء كان ظاهرًا للعيان أو مخفيًا عن الأنظار).
· التأثير: يكفي أن يحمل أحد الشركاء فقط السلاح لتطبيق العقوبة على جميع المشاركين في السرقة، تطبيقًا لقاعدة “اشتراك الجناة في الظرف المشدد”.
ب. وجود السلاح في وسيلة النقل (الناقلة):
· الوسيلة: الناقلة ذات المحرك (كالسيارة، الدراجة النارية، الشاحنة، إلخ).
· الشرط: أن يكون السلاح موجودًا داخل هذه الوسيلة، سواء استخدمت للوصول إلى مكان الجريمة أو للهروب منها.
· التأثير: مرة أخرى، يكفي أن يحتفظ أحد السارقين بالسلاح في السيارة لتطبيق عقوبة المؤبد على الجميع.
3. ما يميز هذا الفصل عن غيرها من سرقات
· لا يشترط العنف: لا حاجة لاستعمال القوة أو العنف ضد المجني عليه.
· لا يشترط التهديد: لا يشترط أن يتم توجيه السلاح أو التلويح به.
· لا يشترط توفر ظروف أخرى: النص صريح في أنه “حتى لو كان السارق شخصاً واحداً ولم تتوفر ظروف مشددة أخرى”.
4. مفهوم السلاح
لم يحدد النص تعريفًا دقيقًا للسلاح، مما يترك مجالاً للتفسير القضائي. يشمل ذلك عادة:
· الأسلحة النارية: (مسدسات، بنادق).
· الأسلحة البيضاء: (سكاكين، مناجل، هراوات).
· أي أداة يمكن اعتبارها سلاحًا بحسب الظروف: مثل مفك براغي كبير، أو عصا ثقيلة، إذا كانت مهيأة للاستخدام كسلاح لإلحاق الضرر.
