وثيقة الحكم الذاتي المغربي للصحراء: هل وجد المغرب الحل النهائي للنزاع الإقليمي؟
تحليل قانوني ودستوري لمقترح الحكم الذاتي المغربي، مع مقارنة بمعايير النماذج الأوروبية ونظرة موضوعية على آفاق السيادة والوحدة الوطنية.
أولاً: الإطار المرجعي والسياق الدبلوماسي
يأتي تداول ما سُمّي “النص الكامل” أو “الملخص التقني الموسّع” لمقترح الحكم الذاتي في سياق دينامية دبلوماسية مرتبطة باجتماعات مدريد برعاية الولايات المتحدة الأمريكية، وما رافقها من وساطة دولية وتسريبات إعلامية متقاطعة. وقد لعب موقع Atalayar دوراً محورياً في نشر ملخص الوثيقة، ما منح النقاش بعداً إعلامياً وقانونياً مزدوجاً: إعلامي من حيث السبق الصحفي، وقانوني من حيث طبيعة الوثيقة ذاتها بوصفها “مشروع نظام أساسي عضوي” أكثر منه إعلان نوايا سياسية.
في هذا السياق، قدم وزير الشؤون الخارجية المغربي ناصر بوريطة الوثيقة مباشرة خلال اللقاء، بحضور أطراف إقليمية ودولية من بينها المبعوث الشخصي للأمين العام للأمم المتحدة ستافان دي ميستورا.
غير أن الأهمية القانونية لا تكمن في الأسماء بقدر ما تكمن في طبيعة النص المتداول: هل نحن أمام وثيقة تفاوضية مرنة أم أمام مسودة نظام دستوري ذي قابلية إدماج مباشر في الهرم المعياري الوطني؟
ثانياً: الهندسة المعيارية للنص – من المبادرة السياسية إلى “النظام الأساسي”
1. التحول من مبادرة 2007 إلى نص عضوي
التحليل المقارن يُظهر أن الوثيقة، وفق ما نُشر، تتجاوز منطق “المبادرة” الذي طبع طرح سنة 2007، لتقترب من بنية Statut d’Autonomie كما هو معمول به في النماذج الأوروبية.
السمات البارزة هنا هي:
- تعريفات معيارية دقيقة.
- أحكام انتقالية.
- آليات رقابة دستورية.
- بنود تفسيرية.
- حماية دستورية ضد التراجع.
هذا التحول يعكس انتقال المقترح من “مستوى السياسة الخارجية” إلى “مستوى القانون الدستوري شبه العضوي”.
2. تقنية توزيع الاختصاصات
تعتمد الوثيقة، بحسب الملخص، تقنية مزدوجة:
- قائمة حصرية لاختصاصات الدولة.
- قائمة تفصيلية لاختصاصات الجهة.
مع قاعدة احتياطية تقضي بأن كل ما لم يُسنَد صراحة للجهة يظل وطنياً، وهي تقنية قريبة من النموذج الإسباني أكثر من الفيدراليات الصلبة.
ثالثاً: المقارنة الأوروبية – إسبانيا وغرينلاند كنموذجين مرجعيين
1. النموذج الإسباني
تُظهر المقارنة مع نظام الحكم الذاتي في إسبانيا، خصوصاً أقاليم مثل كاتالونيا والأندلس، تشابهاً في:
- البرلمان الجهوي بغرفة واحدة.
- الصلاحيات التشريعية القطاعية.
- الرقابة الدستورية المركزية.
- مفهوم “الولاء الدستوري”.
غير أن الفارق الجوهري يتمثل في أن الوثيقة المغربية – وفق التسريبات – تُبقي رموز السيادة والدبلوماسية والعملة حصراً للدولة دون أي مرونة، بينما تسمح إسبانيا بهوامش تعاون خارجي ثقافي واقتصادي أوسع للأقاليم.
2. نموذج غرينلاند
أما المقارنة مع غرينلاند فتبرز في:
- تدبير الموارد الطبيعية.
- الهوية الثقافية.
- الصلاحيات الجبائية الواسعة.
لكن الاختلاف الجوهري أن غرينلاند تملك أفق تقرير مصير قانوني نظري، في حين أن المقترح المغربي – كما هو معروض – يقوم على مبدأ عدم القابلية للتراجع الترابي وإغلاق الباب التأويلي أمام الانفصال.
رابعاً: البنية المؤسساتية – التوازن بين الشرعية الانتخابية والمرجعية السيادية
1. البرلمان الجهوي
الوثيقة تقترح برلماناً بتركيبة مزدوجة:
- انتخاب مباشر نسبي.
- تمثيل تقليدي قبلي مؤطر قانونياً.
هذه الصيغة تمثل محاولة للجمع بين الشرعية الديمقراطية الحديثة والشرعية الاجتماعية التاريخية، وهي مقاربة نادرة في النماذج الأوروبية التي تميل إلى التمثيل الانتخابي الصرف.
2. السلطة التنفيذية
آلية تعيين رئيس الحكومة الجهوية من طرف الملك تمثل نقطة التوتر الأساسية.
قانونياً، هذه الآلية تضمن:
- وحدة السلسلة التنفيذية.
- تفادي ازدواجية الشرعيات.
- الحفاظ على مبدأ السيادة غير القابلة للتجزئة.
خامساً: الأنظمة المالية والجبائية – الاستقلال المالي المراقَب
الوثيقة، وفق الملخص، تتبنى نموذج الاستقلال المالي النسبي القائم على:
- ضرائب جهوية.
- إتاوات الموارد الطبيعية.
- حصة من المداخيل الوطنية.
- صندوق تضامن وميزان توازن.
هذا النموذج يشبه إلى حد بعيد النظام المالي للأقاليم ذات الحكم الذاتي في جنوب أوروبا، مع إضافة عنصر رقابة مزدوجة (جهوية ووطنية) على الاستثمارات الأجنبية، وهو عنصر أقل حضوراً في النماذج الأوروبية الليبرالية.
سادساً: العدالة الانتقالية والمصالحة – بعد قانوني إنساني
تُبرز الوثيقة بُعداً انتقالياً يشمل:
- عودة السكان.
- لجان تحقق الهوية.
- مساطر طعن.
- نزع السلاح وإعادة الإدماج.
- عفو منظم يستثني الجرائم الدولية.
هذا البعد يجعل النص أقرب إلى اتفاقات التسوية الدستورية المركبة وليس مجرد نظام حكم ذاتي إداري.
سابعاً: الإدماج الدستوري والحصانة المعيارية
إدماج النظام في الدستور مع بند حصانة وتقييد التعديل بأغلبيات معززة يضع الوثيقة في مرتبة المعيار الدستوري الفوق-عادي، وهو نهج قريب من المدرسة الدستورية الفرنسية في إدماج الاتفاقات السياسية ذات القيمة العليا.
ثامناً: التقييم الموضوعي وفق المعايير الدولية
نقاط القوة:
- وضوح توزيع الاختصاصات.
- حماية دستورية قوية.
- توازن بين الهوية المحلية والسيادة الوطنية.
- آليات رقابة مؤسسية متعددة.
- بعد مصالحي انتقالي متقدم.
نقاط الحساسية:
- آلية تعيين رئيس الحكومة الجهوية.
- تضييق هامش العلاقات الخارجية الجهوية.
- مركزية رموز السيادة بشكل صارم.
- غياب أفق تقرير المصير النظري مقارنة ببعض النماذج الشمالية.
خلاصة معيارية
من منظور قانون دستوري مقارن، يُمكن توصيف الوثيقة – وفق ما هو متداول – بأنها نموذج حكم ذاتي موسّع ذي سقف سيادي مغلق.
فهي لا تنتمي إلى الفيدرالية الكلاسيكية، ولا إلى اللامركزية الإدارية البسيطة، بل إلى فئة وسطى يمكن تسميتها:
“الحكم الذاتي الدستوري المندمج” — نموذج يستعير أدوات أوروبا الجنوبية في التنظيم المؤسسي، ويضيف إليها فلسفة دستورية فرنسية في التحصين المعياري، مع تكييف واضح مع خصوصية الدولة الوحدوية المغربية.
