تعويض مغربي بـ2.5 مليون يورو بعد 18 سنة سجنا ظلما في إسبانيا
في واحدة من أبرز قضايا الأخطاء القضائية التي هزت إسبانيا خلال العقود الأخيرة، حصل المواطن المغربي أحمد الطموحي على حكم نهائي يقضي بتعويضه بمبلغ 2.5 مليون يورو، بعدما أمضى سنوات طويلة خلف القضبان في قضية اغتصاب تبين لاحقاً أنه لا علاقة له بها.
وجاء قرار المحكمة العليا الإسبانية ليضع حداً لمعركة قضائية استمرت سنوات، بعدما أقرت بوجود خطأ جسيم في مسار القضية التي أدت إلى سجن الطموحي لمدة 15 عاماً، تلتها ثلاث سنوات إضافية تحت المراقبة القضائية، قبل أن تكشف الأدلة العلمية براءته الكاملة.
وتعود تفاصيل القضية إلى تسعينيات القرن الماضي، عندما جرى توقيف أحمد الطموحي وإدانته بناءً على تعرف بعض الضحايا عليه خلال إجراءات عرض المشتبه فيهم. غير أن التحقيقات اللاحقة أظهرت وجود تشابه كبير بينه وبين الجاني الحقيقي، وهو مواطن إسباني يدعى أنطونيو غارسيا كاربونيل، ما أدى إلى وقوع واحد من أكثر الأخطاء القضائية إثارة للجدل في البلاد.
ومع تطور تقنيات تحليل الحمض النووي، ظهرت معطيات جديدة قلبت مجرى الملف بالكامل، حيث أكدت الفحوصات الجينية أن الطموحي ليس مرتكب الجرائم التي أدين بسببها، الأمر الذي مهد الطريق أمام تبرئته وإعادة فتح النقاش حول مسؤوليته الدولة في تعويضه.
ورغم صدور أحكام سابقة أنصفت الرجل وأثبتت براءته، فإن وزارة العدل الإسبانية رفضت في مرحلة سابقة منحه تعويضاً، معتبرة أن القضية لا تتضمن خطأ قضائياً واضحاً يبرر ذلك. كما أيدت المحكمة الوطنية هذا الموقف، قبل أن تتدخل المحكمة العليا وتلغي تلك القرارات بشكل نهائي.
واعتبرت أعلى هيئة قضائية في إسبانيا أن ما تعرض له الطموحي يمثل خطأ قضائياً “واضحاً ومحدداً”، مشيرة إلى أن معطيات وخبرات أساسية لم تحظ بالتقييم اللازم خلال مراحل المحاكمة، وهو ما تسبب في حرمانه من حريته لسنوات طويلة دون وجه حق.
وبعد عقود من المعاناة، عبّر أحمد الطموحي، البالغ من العمر 75 عاماً، عن ارتياحه لصدور الحكم، مؤكداً أن التعويض المالي لن يعوضه عن السنوات التي فقدها بعيداً عن أسرته وحياته الطبيعية.
وقال في تصريحات لوسائل إعلام إسبانية إن أكثر ما ساعده على الصمود خلال سنوات السجن كان المكالمات التي كان يتلقاها من ابنته المقيمة بمدينة الناظور، إلى جانب دعم شقيقه وبعض الأشخاص الذين ظلوا مقتنعين ببراءته منذ البداية.
وتعيد هذه القضية إلى الواجهة الجدل حول الأخطاء القضائية وأثرها على حياة الأبرياء، خاصة عندما تتحول الشبهات أو التشابهات الشكلية إلى أحكام تسلب الإنسان سنوات من عمره قبل أن تثبت الحقيقة عكس ذلك.
