محكمة النقض تحسم الجدل حول كاميرات المراقبة بالمنازل: الأمن لا يبرر انتهاك الخصوصية
أصدرت محكمة النقض بالرباط قراراً قضائياً مهماً وضع حداً للجدل المتعلق باستخدام كاميرات المراقبة من قبل المواطنين في محيط منازلهم، مؤكدة أن اعتبارات الأمن وحماية الممتلكات لا تعفي أصحاب العقارات من احترام القوانين المنظمة لحماية المعطيات الشخصية والحياة الخاصة للأفراد.
وجاء القرار على خلفية نزاع قضائي نشب بين مكتري شقة تقع بالطابق السفلي لإحدى الفيلات بمنطقة عين الذئاب بمدينة الدار البيضاء ومالكي العقار. وكان المكتري قد تقدم بدعوى يطالب فيها بإزالة كاميرات مراقبة اعتبر أنها تنتهك خصوصيته، إضافة إلى سياج حديدي قال إنه يعيق ولوج سيارته إلى المرآب.
وفي المرحلة الابتدائية، قضت المحكمة بإزالة الكاميرات والسياج الحديدي، مع الحكم بتعويض لفائدة المكتري. غير أن مالكي الفيلا استأنفا الحكم، مؤكدين أن الكاميرات تم تركيبها لأسباب أمنية بحتة، وأنها موجهة لمراقبة المداخل والممرات المشتركة دون استهداف الفضاء الخاص بالمكتري.
وخلال مختلف مراحل التقاضي، شدد المالكان على أن موقع الفيلا يفرض اتخاذ تدابير أمنية لحماية الأشخاص والممتلكات، كما استندا إلى تقرير الخبرة الذي أكد أن الكاميرات لا ترصد غرفة المكتري ولا تراقب فضاءه الشخصي.
ورغم ذلك، أيدت محكمة الاستئناف الحكم الابتدائي، معتبرة أن استخدام كاميرات المراقبة يظل خاضعاً لمقتضيات القانون رقم 09.08 المتعلق بحماية الأشخاص الذاتيين تجاه معالجة المعطيات ذات الطابع الشخصي، وخاصة ما يرتبط بواجب إشعار الأشخاص المعنيين بوجود نظام للمراقبة بواسطة علامات واضحة وبارزة.
وفي قرارها الصادر بتاريخ 16 أبريل 2024، أكدت محكمة النقض أن لكل شخص الحق في الاعتراض على معالجة المعطيات المتعلقة به، وأن عدم إثبات إشعار المعنيين بوجود الكاميرات وفق الشروط القانونية يجعل قرار إزالتها مستنداً إلى أساس قانوني سليم.
وانتهت المحكمة إلى رفض طلب النقض المقدم من مالكي العقار، وتأييد الأحكام الصادرة في المراحل السابقة، ما يجعل هذا القرار مرجعاً قضائياً بارزاً في مجال تنظيم استخدام كاميرات المراقبة بالمساكن.
ويرى متابعون أن هذا الحكم يكرس التوازن بين حق الأفراد في حماية ممتلكاتهم وضمان أمنهم، وبين ضرورة احترام الحق في الخصوصية وحماية المعطيات الشخصية، بما ينسجم مع المقتضيات الدستورية والقانونية المعمول بها في المغرب.
